The Court notes that Defendant filed a Motion to Enforce Protective Order with the
Arizona Court of Appeals on October 26, 2015. According to the website entry dated December
3, 2015, the Court of Appeals denied the motion. Because Defendant has raised the argument
that the Superior Court lacks jurisdiction to enter an order unsealing a minute entry, this Court
waited to address the instant motion in an abundance of caution. This Court will treat the Court
of Appeals’ ruling as a rejection of that argument.

The Court has considered the Request of CNN and PNI For Unsealing of Transcript filed October 4, 2013, the Defendant’s Response to the Request of CNN and PNI for Unsealing of Transcript filed November 14, 2013 and the oral argument conducted on November 26, 2013.CNN and PNI seek an order unsealing the transcript of a hearing conducted on October 4, 2013 regarding Defendant’s Motion to Preclude or Limit Live Coverage of the Sentencing Phase Retrial. Defendant opposes the request to unseal portions of the transcript until the trial phase proceedings are complete. The State does not object to unsealing the transcript in its entirety. The Court has reviewed the sealed transcript from the October 4, 2013 proceeding. The Court finds portions of the transcript should be unsealed. The remainder of the transcript will remain sealed until the sentencing phase retrial is completed. The Court finds the sealed portions should remain sealed for the reasons set forth in the court’s minute entry dated October 1, 2013. A copy of the redacted transcript will be filed with the Clerk of the Court and placed on the docket.
